Cell phone manufacturer, dealer fined for selling defective handset

PUNE: The district consumer court has directed mobile phone manufacturer Microsoft Mobile Device (Nokia), its authorized care center and the dealer in Pune to refund Rs 17,700 and pay Rs 5,000 compensation to a Yerawada resident for causing deficiency in service by selling a defective handset.

Vikas M Sonawane, the complainant, had purchased a `Nokia Lumia 720' mobile handset for Rs 17,700 on May 4, 2013 from dealer J M Mobile Shoppe on the J.M. road. Initially, the handset worked properly but, after a few days it started giving problems as it would hand and shutdown frequently.

Sonawane then approached the dealer and, later, the authorised care center `B M Gadget Services Private Limited' at Erandwane and got the handset repaired not just once but twice after the problem persisted. On the second occasion, he even paid Rs 525 to the care center towards extending the warranty of the handset for an additional one year period. The problem kept continuing and for a third time Sonawane got the handset repaired and eventually approached the care center for replacing the handset with a new one. However, the latter assured him that the handset would be sent to the manufacturer and be repaired for a fourth time. In April 2014, Sonawane once again handed over the handset to the care center and the same was sent to the manufacturer. On May 25, 2014, the handset was returned to him with a claim that all problems were sorted out. Barely two days later, the problem in the handset reoccurred and when Sonawane insisted for nothing short of replacement of the defective handset with a new one, the care center refused his request. He then approached the consumer court. The bench of V P Utpat, O G Patil and Kshitija Kulkarni cited the evidence on record and arguments from either sides while holding the mobile manufacturer, care center and dealer jointly and severally liable for causing deficiency in service.
